This website is operated by Blackseries RV Inc ("we", "us", "our"), trading as Black Series Marine, of 2072 W 11th St, Upland, CA 91786, United States. By accessing this website or placing an order, you agree to these Terms of Service.
2. Eligibility
You must be at least 18 years old and legally able to enter into a binding contract to order from us.
3. Products, specifications and images
Product photographs, renders and diagrams on this website are representative. Finish, fittings, color and detail may vary between the imagery and the unit supplied.
Published dimensions, weights and capacities are nominal and subject to manufacturing tolerance. Where any figure on this website conflicts with the certified label affixed to the unit, the certified label governs. We reserve the right to improve or change specifications without notice.
4. Capacity ratings and safe use
Load, payload, passenger and axle ratings published on this website are guidance only. You are responsible for operating within the ratings on the certified capacity plate or trailer label, within your tow vehicle's rated capacity, and in accordance with applicable federal, state and local law.
Nothing on this website is a substitute for a certified label, a qualified marine survey, or your own verification of fitness for your intended use.
5. Pricing and errors
Prices are in US dollars and exclusive of taxes unless stated. We make every effort to price accurately, but if a product is listed at an incorrect price due to a typographical or system error, we may cancel or refuse any order placed at that price, including after an order confirmation has been sent. If we cancel on this basis and you have already paid, we will refund you in full.
6. Orders and acceptance
Your order is an offer to buy. An order confirmation email acknowledges receipt but does not constitute acceptance. A contract is formed only when we confirm the order in writing or dispatch the goods, whichever occurs first. We may decline any order.
7. Deposits
Where a deposit is offered at checkout, the deposit is fully refundable at any time before fabrication of your unit begins, and reserves a build slot. The deposit amount is credited against the final purchase price if the order proceeds. Refund requests should be made in writing to the contact details below.
8. Custom and made-to-order builds
Custom lengths, commercial specifications and any unit built to your specification are made to order and cannot be returned or refunded once fabrication has begun, because they cannot be resold. We will confirm this in writing before accepting a custom order. Cancellation terms before fabrication are as stated in your written quote.
9. Delivery, title and risk
Delivery terms are set out in our Shipping & Delivery policy, which forms part of these Terms. Delivery dates are estimates and time is not of the essence. Risk passes to you on delivery. Title passes on delivery or on receipt of payment in full, whichever is later.
You must inspect the goods on delivery and note any visible transit damage on the carrier's paperwork before signing.
10. Titling, registration and compliance
Unless expressly agreed in writing, you are responsible for titling, registering, insuring and licensing the boat and trailer in your jurisdiction, and for any associated fees and taxes. Requirements vary by state. We will supply the documentation reasonably required to complete registration.
11. Warranty
Stock boats and trailers are covered for the original retail purchaser by a 1-year limited comprehensive warranty against defects in materials and workmanship in fittings, decking, seating, hatches, axles, couplers, winches and lighting, and a 5-year limited structural warranty covering the hull plating, frame and transom structure against failure caused by defects in materials or workmanship, each beginning on the date of delivery.
The warranty does not cover: cosmetic damage such as scratches, dents and fading; normal wear items such as tires, bunk carpet, straps and bearings; corrosion resulting from failure to rinse after saltwater use, missing or depleted sacrificial anodes, or improper installation of dissimilar metals; or damage caused by accident, misuse, overloading beyond rated capacity, unapproved modification, improper trailering or hull support, or inadequate maintenance. Warranty terms for custom and commercial builds are stated in the written quote.
To make a claim, contact us at the details below with your order number, photographs and a description of the issue. We will respond within one business day and either arrange repair, supply replacement parts, or replace the unit at our option.
Except as expressly stated in that warranty and to the fullest extent permitted by law, the goods are supplied without other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including under applicable consumer protection law.
12. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, loss of profit, loss of use, or loss arising from your operation of the goods. Our total liability arising from any order will not exceed the amount you paid for that order.
13. Returns
Returns are governed by our Returns Policy, which forms part of these Terms.
14. Acceptable use
You may not use this website unlawfully, attempt to gain unauthorized access to it, scrape it at a rate that burdens it, or reproduce its content without permission.
15. Intellectual property
All content on this website, including text, imagery, diagrams and specifications, is our property or licensed to us and may not be reproduced without written permission.
16. Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to conflict of law rules. The state and federal courts located in San Bernardino County, California have exclusive jurisdiction, except where applicable consumer law gives you the right to bring proceedings elsewhere.
17. Changes to these Terms
We may update these Terms from time to time. The version in force at the time you place an order governs that order.
